Terms & Conditions – The Spine Code

1. General

These Terms & Conditions apply to all products and services offered through this website, including online courses, programs, coaching sessions, and digital content.

By purchasing or accessing any product or service, you agree to be legally bound by these terms.

2. Nature of the Services

All programs, courses, and content provided by The Spine Code are intended for educational, informational, and personal development purposes only.

They do not constitute:

Medical advice, diagnosis, or treatment
Psychological or psychiatric care
Physical therapy or rehabilitation
Professional healthcare services of any kind

Some methods may include physical movement, breathwork, or emotional processing techniques.

You are strongly advised to consult a qualified healthcare professional before participating, especially if you have:

Existing medical conditions or injuries
Psychological vulnerabilities or mental health diagnoses
Are pregnant or have recently given birth
Have a history of trauma or PTSD

3. Responsibility & Results

You participate voluntarily and are fully responsible for your own decisions, actions, and results.

Individual outcomes vary significantly. No guarantees are made regarding:

Health improvements or physical recovery
Emotional change or healing
Personal transformation or life changes
Specific measurable results

The Spine Code provides tools, guidance, and educational content — your results depend entirely on your personal commitment, individual circumstances, health status, and how you apply the teachings.

4. Access & Use

After purchase, access is granted to one individual account only.

Access is non-transferable and may not be shared with others.

Usage Restrictions

You may not:

Share login credentials with others
Copy, reproduce, distribute, or resell any content
Record, screenshot, or redistribute video content or course materials
Use materials for commercial purposes without prior written permission from The Spine Code
Reverse engineer, decompile, or create derivative works from the content

Account Security

You are responsible for:

Maintaining the confidentiality of your login information
All activities that occur under your account
Notifying us immediately of any unauthorized access

Duration of Access

Unless otherwise stated at the time of purchase, access to digital courses is provided according to the terms specified (e.g., lifetime access, 12 months, 6 months).

The Spine Code reserves the right to update or modify course content at any time without prior notice.

5. Payments

Pricing

All prices are listed in euros (EUR).

For consumers (B2C): Prices include VAT (BTW) unless stated otherwise
For businesses (B2B) within the EU: VAT may be reverse-charged if a valid VAT number is provided
For businesses outside the EU: No VAT is charged

Payment Processing

Payments are processed securely via third-party providers such as Stripe or PayPal. We do not store your full credit card information.

Payment Plans

If you choose to pay in installments:

The full amount remains payable regardless of whether you complete the program or use all the content
You remain legally bound by these Terms throughout the entire payment period
Missed payments may result in temporary suspension of access until payment is received
Your account will be fully reactivated once payment is complete

Late Payments

In accordance with Dutch law, we reserve the right to charge:

Statutory interest on overdue amounts
Reasonable collection costs for payment recovery efforts

If payment issues persist, we may refer the matter to a collection agency.

Technical Payment Issues

If you experience technical problems with payment or access after successful payment, contact us within 48 hours at [email protected] for immediate assistance.

6. Right of Withdrawal & Refunds

Digital Products (Online Courses & Programs)

In accordance with EU consumer law (Article 6:230p of the Dutch Civil Code), you have a 14-day right of withdrawal.

However, this right is waived when:

You receive immediate access to digital content, AND
You explicitly consent during checkout to receiving immediate access and acknowledge the loss of your right of withdrawal

By completing your purchase and accessing the content, you acknowledge and accept this waiver.

This means: No refunds are provided once access to digital content has been granted.

Coaching & Live Sessions

For individual coaching sessions or live group calls:

Cancellations must be made at least 24 hours in advance
Late cancellations (less than 24 hours) or no-shows may result in forfeiture of the session without refund or rescheduling
Rescheduling is subject to availability and must be requested in writing

Exceptions

If you experience technical issues that prevent access to purchased content, and these issues cannot be resolved by our support team, a refund may be issued at our discretion.

7. Liability & Disclaimer

Limitation of Liability

The Spine Code and its representatives are not liable for:

Any direct or indirect damages arising from participation
Physical injury, pain, or discomfort
Emotional distress or psychological harm
Financial loss or lost opportunities
Decisions or actions taken based on the content provided

All participation and use of content are entirely at your own risk.

You acknowledge that you are participating voluntarily and assume full responsibility for any consequences.

Exceptions to Limitation

The above limitations do not apply in cases of:

Gross negligence or willful misconduct by The Spine Code
Liability that cannot be excluded under mandatory Dutch law (e.g., death or personal injury caused by negligence)

Force Majeure

The Spine Code is not liable for delays or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to:

Illness or personal emergency
Technical failures or internet outages
Natural disasters
Government restrictions or orders
Third-party service disruptions (e.g., Kajabi, Stripe)

In such cases, obligations will be suspended until the circumstance is resolved, or alternative arrangements will be offered where possible.

8. Intellectual Property

All materials provided through The Spine Code, including but not limited to:

Text content, video recordings, audio files
Exercises, methods, frameworks, and techniques
Graphics, worksheets, templates, and handouts
Course structure, curriculum, and design
Trademarks, logos, and branding

...are the exclusive intellectual property of The Spine Code and are protected by Dutch and international copyright law.

Usage Rights

Your purchase grants you a personal, non-exclusive, non-transferable license to access and use the materials for your own personal development only.

You do not have the right to:

Teach, share, or redistribute the methods commercially
Create derivative works or training materials based on the content
Use the materials in your own professional practice without explicit written permission

Enforcement

Unauthorized use, reproduction, or distribution may result in:

Immediate termination of access without refund
Legal action and claims for damages
Reporting to relevant authorities

9. Termination of Access

The Spine Code reserves the right to terminate or suspend your access immediately and without prior notice if you:

Violate these Terms & Conditions
Share account credentials or course content
Engage in abusive, threatening, or disruptive behavior toward staff or other participants
Misuse the platform or attempt to gain unauthorized access
Fail to make payments as agreed
Engage in any illegal activity related to the services

No refunds will be issued in case of termination due to violation of these terms.

You may terminate your account at any time by contacting us at [email protected]. Termination does not release you from payment obligations for services already provided or installment plans in progress.

10. Changes to Terms

The Spine Code reserves the right to modify these Terms & Conditions at any time.

The most recent version will always be available on this website and will apply to:

All future purchases made after the update
Ongoing use of the services

For existing customers: Material changes affecting your existing purchase will be communicated via email at least 14 days before taking effect.

Continued use of the services after changes constitutes acceptance of the updated terms.

11. Governing Law & Dispute Resolution

These Terms & Conditions are governed by Dutch law.

Any disputes arising from these Terms or your use of our services will be submitted to the competent court in Limburg, the Netherlands.

Alternative Dispute Resolution

Before initiating legal proceedings, we encourage you to contact us directly to resolve any issues amicably.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
